Asset search is the process of searching, locating, investigating and verifying a person's assets (e.g., property, real estate, vehicles or bank accounts) with financial institutions, online payment institutions, insurance institutions, securities institutions, real estate registries, vehicle registries, market surveillance departments, housing fund administrations and others.

The specific content of an asset search depends on the purpose of the search for hidden assets. For example, if the search is for court-ordered executable property, the search may focus on physical assets. If the purpose is to assess the financial situation of an individual or a company, the search may focus on financial assets.

Why need Asset Search in China?

In cooperative trade with Chinese companies and suppliers, you may sue Chinese companies and suppliers to recover losses and claim compensation for intellectual property infringement, commercial disputes, investment fraud, business fraud, supplier fraud, factory scams and many other reasons.

For foreign companies, suing Chinese companies is very complicated and challenging, especially after spending a lot of time, energy and money on legal proceedings, but after winning the case, the executors and debtors do not fulfill their legal obligations and evade their legal liabilities, which makes the judgment unenforceable, and as a result, there is an empty paper with a successful judgment, but they are unable to recover their losses and obtain compensation.

Chinese courts will notify the applicant for execution to provide property clues. And search for property in the name of the executed person through the network execution search and control system.
However, because of data interoperability, there are certain limitations for Chinese courts to inquire into the property of the executed person; the search and control system does not cover all property registrations, and the results of the inquiry may be missing, and there may be discrepancies between the system data and the real situation.

If the property clues of the executor cannot be effectively searched, it will result in the applicant for execution being left with an empty judgment in favor of the executor, but unable to recover losses and obtain compensation.
If executable property is found, the court will take appropriate enforcement measures depending on the type of property. Bank deposits may be frozen and transferred, while other types of property are seized, impounded or frozen, and then realized through judicial auction.
